I trying to create a new Folder Structure based on the file extension within the current folders then move the files to the correct folder, I have seen the Processing Subfolders, however I don't know how and when to Create the new Folder Structure based on the Processing Subfolders rules...

There's no built in action to create folders by itself. The Sort into subfolders will create them as needed though. If you could provide more details on what you are doing (i.e. provide a concrete example), I can better assist.

Thanks for the reply...
I have had to recover by photos, and there are sitting in 3 Top Level Folders, what I wish to do is Create a folder structure on the extensions of the files i.e. jpg (JPEG), Raw, Tiff etc, then rename the files by setting it to the created date_######_ext...

You should be able to use Sort into subfolders for that. It will create the folders as needed. Check the manual if you need more help on how to do that.

I have created a Rule to Go into Subfolders then Sort to Subfolders when ran I get an error Could Not Move Source and Destination are the same...

Search the help for "subfolders". The way it sounds, you are trying to sort folders into subfolders, not files. The chapter in the help should hopefully clear that up.
